Berry Real Estate
Privacy Policy
Last revised September 2026
Harold Berry, a real estate broker with Windermere Real Estate Midtown (“Harold Berry,” “we,” “our,” or “us”), understands your privacy is important. This Privacy Policy describes how we collect, use, store, process and share your information in relation to your access and use of this website (the “Site”) and any related services that link to this Privacy Policy (together, the “Service”). By visiting, accessing or using the Service, you consent to the collection, use, storage, transfer, processing and disclosure of your information, including personally identifiable information, as described in this Privacy Policy. If you do not agree with this Privacy Policy, please do not access or use the Service.
The Service and its associated systems are housed on servers in the United States. If you are located outside of the United States, information we collect (including cookies) is processed and stored in the United States, which may not offer the same level of privacy protection as the country where you reside. By using the Service and providing information to us, you consent to the transfer and processing of your information in the United States.
1. Information Collection
1.1 Summary of Information Collected
The table below summarizes the categories of personal information we may collect through the Service. We obtain this information using the methods described in this Privacy Policy.
1.2 Descriptions of Information Collected
(a) General. You can browse the Site without submitting any personally identifiable information about yourself. We will, however, receive and store some non-personally identifiable information about you, as described below. “Personally identifiable information” is information that would allow us to identify you, such as your name, postal address, email address or telephone number. We collect this information when you complete the contact form, request a home valuation, send us an email or text message, call us, or otherwise communicate with us. You may also be asked to provide information about a home or other real estate property. You may also provide information about a third party, for example a co-buyer or family member, and you should only do so with that person’s permission.
(b) Location Information. When you use the Service, we may receive your generic location (such as city or neighborhood) based on your IP address. We do not collect precise geographic location data.
(c) Automatically Collected Information. Similar to other websites, we and our website hosting and analytics providers (“Service Providers”) may collect some information automatically and store it in log files. This may include your IP address, browser type and language, device type, referring and exit pages and URLs, platform type, number of clicks, landing pages, cookie information, the pages you requested and viewed, the amount of time spent on particular pages, and the date and time of each request. We collect this information to better understand our visitors, to operate the Service efficiently, and to improve the quality of the Service. We may collect this information using tracking technologies such as cookies and web beacons.
Cookies. A cookie is a small text file that is stored on a computer or smartphone for record-keeping purposes. Cookies may be used to record information about your activities while using the Service and to recognize you when you return. Some cookies remain on your device until you delete them. Others, like session cookies, expire when you close your browser. You may set your browser or device to reject cookies and still use the Site, although some features may not work as intended. We do not control the use of cookies by third parties.
Web Beacons. Web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs) are tiny graphics with a unique identifier, embedded invisibly on web pages or in emails, that are used to understand how visitors interact with a site or message. We do not control the use of web beacons by third parties.
(d) Third-Party Analytics. We may use analytics providers, such as Google Analytics, to collect information about how visitors use the Service, including the pages where visitors enter and leave the Site, the pages viewed, time spent on each page, browser version, operating system, IP address, and general location. These providers collect and use information under their own privacy policies. For more information about how Google uses information, visit https://policies.google.com/privacy. To opt out of Google Analytics, visit https://tools.google.com/dlpage/gaoptout.
(e) “Do Not Track” Settings. Because Service usage information may be collected through cookies, web beacons, and similar technologies, selecting the “Do Not Track” option in your browser may not affect this collection. The most effective way to limit it is to manage the settings on your browser and device to delete and disable cookies and similar tools.
We may use or disclose the personal information identified above for the following business purposes:
- To respond to your inquiry and fulfill the reason you provided the information, such as answering questions, preparing a home valuation, or helping you buy or sell a home.
- To communicate with you and provide the real estate services you request.
- To operate, maintain and improve the Site and the Service.
- For marketing, only where you have asked to receive it or where permitted by law.
- To help maintain the safety, security, and integrity of the Site and our business.
- To respond to law enforcement requests and as required by applicable law, court order, or governmental regulations.
- To prevent illegal activity, fraud, and abuse.
- As otherwise described to you when we collect your personal information.
2. Information Use
(a) General. We use your personally identifiable information to respond to you, to provide real estate services, to monitor Site usage, and to improve the Service. We may also use it to resolve disputes; to detect and protect against errors, fraud, and illegal activity; to comply with legal and licensing obligations; to enforce this Privacy Policy and the Terms of Use; or for any other purpose described in this Privacy Policy or described to you at the time of collection.
(b) Communications. We use your personally identifiable information to respond to your inquiries and requests. If you have asked to receive them, we may also send you updates about the real estate market, properties, or our services. You may stop receiving promotional emails at any time by using the unsubscribe link in the email or by contacting us. If you receive text messages from us, you may reply STOP at any time to opt out. Message and data rates may apply. Even if you opt out of promotional messages, we may still contact you about an active inquiry or transaction.
(c) Use of Non-Personally Identifiable and Aggregate Information. We may use non-personally identifiable and aggregate information for any lawful purpose, including analyzing trends and improving the Site and the Service. We will take reasonable steps to ensure that aggregate information is never associated with you or your personally identifiable information.
(d) Information Retention. We retain your information for as long as reasonably necessary to respond to you, provide our services, and meet our legal, licensing, and record-keeping obligations. When information is no longer needed, we will delete it or keep it only in a form that does not identify you, subject to applicable law.
3. Information Disclosure
We do not sell your personal information. We may disclose your information only as described below.
3.1 Brokerage and Service Providers. We may disclose your information to Windermere Real Estate Midtown, Windermere Real Estate Services Company, members of our team, and service providers that support the Site and our business (such as website hosting, email, customer relationship management, and analytics providers). These parties may use your information only to help us operate the Service and provide our services, or under their own privacy policies where noted in this Privacy Policy.
3.2 Transaction Professionals. With your permission, or as needed to carry out a real estate transaction you have asked us to help with, we may share information with other parties to the transaction, such as lenders, escrow and title companies, inspectors, appraisers, and other brokers.
3.3 Legal Requirements. In some cases, we may disclose your information: (i) as required by any applicable law, rule or regulation; (ii) if we believe disclosure is needed to protect our rights, property or safety; (iii) to government regulators or law enforcement authorities in connection with any judicial proceeding, court order, subpoena or legal process; and (iv) to respond to a physical threat to you or another person.
3.4 Business Transitions. If our business, or the brokerage we are affiliated with, is involved in a reorganization, merger, transfer, or similar transaction, your information may be disclosed to the parties involved, subject to this Privacy Policy.
3.5 Disclaimer. We cannot ensure that your personally identifiable information will never be disclosed in ways not otherwise described in this Privacy Policy. For example, a third party may unlawfully intercept or access transmissions or private communications. No transmission of data over the internet can be 100% secure.
4. Information Security Measures
We use reasonable measures to protect the personal information we receive. Information you submit through the Site is stored in environments that are not available to the public. However, no transmission of data over the internet or any other public network can be guaranteed to be 100% secure.
5. Children’s Privacy
The Service is not intended for anyone under the age of 18, and we do not knowingly collect personally identifiable information from children under the age of 13. If you believe a child has provided information to us through the Service, please contact us at haroldberry@windermere.com.
6. Your Privacy Rights
Depending on where you live, you may have the right to request that we tell you what personal information we have collected about you, correct information that is inaccurate, or delete your personal information. You may also ask us to stop sending you marketing communications at any time. To make a request, contact us using the information in Section 12. We may need to verify your identity before responding, and we will respond within forty-five (45) days or within the time required by applicable law. We will not discriminate against you for exercising any of these rights.
California residents: California Civil Code Section 1798.83 permits California residents to request, once a year and free of charge, a list of third parties to whom we have disclosed personally identifiable information for their direct marketing purposes in the preceding calendar year. We do not disclose personal information to third parties for their own direct marketing purposes.
7. Visitors Outside the United States
The Service is intended for use in the United States. If you provide personally identifiable information to us from outside the United States, it will be transferred to and processed in the United States, which may not have privacy laws comparable to those where you live. By providing your information, you consent to this transfer and processing.
8. Linked Sites
The Site includes links to other websites, such as Windermere.com and third-party real estate services (“Linked Sites”). We are not responsible for the content, privacy practices or policies of Linked Sites. Linked Sites are subject to their own terms of use and privacy policies, which you should review.
